With the retirement of Supreme Court Justice Stephen Breyer, President Biden is expected to nominate a black woman as a replacement. Three women are expected to be the top contenders, and each has its own history with the LGBTQ+ community. Ketanji Brown Jackson has past associations with Breyer, having been a clerk for him. She is known for her work as a progressive Public Defender but has also been an advisor for a strictly Anti-LGBTQ+ Baptist school. J. Michelle Childs, who has bipartisan support, has a history with the LGBTQ+ community. As a trial judge in South Carolina, she rejected a lawsuit for marriage equality in the state, although she did say that the state had to recognize out-of-state unions. Another person who is expected to possibly be a nominee is Leondra Kruger, a member of the California legal community who was a keynote speaker in 2019 for the annual dinner for the Tom Homann LGBT Law Association, a San Diego-based affinity group for LGBTQ lawyers. None of these people have been confirmed, but they are all possible candidates for the open seat of Supreme Court Justice.
